License to Use Digital Products: Upon your purchase of a digital product, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access, download, and use the purchased digital product for your personal, non-commercial, educational purposes only, subject to these Terms.
Strict License Restrictions: You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download (except as expressly permitted), store, or transmit any of the material on our Site or in our digital products. For digital products specifically designated for download (e.g., e-books), you may download one copy to a single device for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL Plastfy, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, OR ANY DIGITAL PRODUCTS PURCHASED, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, PERSONAL INJURY, LOSS OF REVENUE, OR LOSS OF PROFITS.

IN NO EVENT SHALL THE TOTAL LIABILITY OF Plastfy TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR PURCHASING THE DIGITAL PRODUCTS IN THE LAST SIX (6) MONTHS, OR $50.00 USD, IF YOU HAVE PAID NOTHING.

11. Indemnification

You agree to defend, indemnify, and hold harmless Plastfy, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your misuse of the Site, Services, or information obtained from our digital products.

12. Governing Law and Jurisdiction

All matters relating to the Site, our Services, and these Terms shall be governed by and construed in accordance with the internal laws of the State of Wyoming, United States, without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding shall be instituted exclusively in the federal or state courts located in Sheridan, Wyoming, USA. You waive any and all objections to the exercise of jurisdiction over you by such courts.

13. Dispute Resolution

At Plastfy’s sole discretion, it may require You to submit any disputes arising from these Terms or use of the Site, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association (AAA) applying United States law.

14. Waiver and Severability

No waiver by Plastfy of any term or condition set out in these Terms shall be deemed a further or continuing waiver. If any provision of these Terms is held by a court to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions will continue in full force and effect.

15. Entire Agreement

The Terms & Conditions, our Privacy Policy, our Refund & Returns Policy, and our Disclaimer constitute the sole and entire agreement between you and Plastfy regarding the Site and Services.
